Recently, the Prime Minister signed Decision No. 15/2020 / QD-TTg, dated April 24, 2020 detailing the implementation of supporting policies for people affected by Covid- 19. Details of subjects, conditions and dossiers, order and procedures for receiving support money are as follows:
1. For employees who temporarily suspend the performance of labor contracts or take leave without pay
* Conditions of support
Workers are supported when fully meeting the following conditions:
– The period of postponement of performance of labor contracts, unpaid leave of work within the term of the labor contract, from 01 month or more from April 1, 2020 to the end of June 30, 2020 and The time to start suspending the performance of unpaid labor contracts or leave is from April 1, 2020 to June 1, 2020.
– Are participating in compulsory social insurance up to the time immediately before suspending the performance of labor contracts or taking leave without pay.
– Working in enterprises with no revenue or no financial source to pay salaries (after using the wage reserve funds, after-tax profit sources and other lawful financial sources of the enterprises, balance until March 31, 2020) affected by the Covid-19 pandemic.
* Support level
Supported monthly with VND 1.8 million / person / month and no more than 03 months.
* Records, order and procedures for implementation
– The enterprise shall make a list of employees who suspend performance of labor contracts, take leave without pay, ensuring conditions for requesting grassroots trade union organizations (if any) and social insurance agencies to certify this List. and enclose the labor contract, social insurance book, the written agreement to suspend the performance of the labor contract or leave without pay.
– Within 03 working days after receiving the list at the request of the enterprise, the social insurance agency shall confirm the employee’s participation in social insurance and send it to the enterprise.
– The enterprise sends the application to the People’s Committee of the district where the office is located. Within 3 working days after receiving a complete dossier, the district-level People’s Committee shall appraise and submit it to the provincial-level People’s Committee president. Within 02 working days after receiving the complete dossier, the President of the provincial People’s Committee shall issue a decision approving the List and support fund; at the same time directing the implementation of support payments.
For employees whose labor contracts and employment contracts are terminated but are not eligible for unemployment benefits
* Conditions of support
Laborers are provided with financial supports when fully meeting the following conditions: having signed labor contracts or working contracts before April 1, 2020 and are currently participating in compulsory social insurance; terminating labor contracts or working contracts for the period from April 1, 2020 to the end of June 15, 2020 but not being eligible for unemployment benefits under regulations; have no income or are below the poverty line.
* Support level:
Receive monthly support with 01 million VND / person / month and no more than 03 months.
* Records, order and procedures for implementation
2. Workers prepare documents including:
– Application for assistance with a copy of one of the following documents:
– The employment contract or employment contract has expired or has been completed under a labor contract;
– Decided to resign;
– Notice or agreement to terminate the labor contract or employment contract;
– Copy of social insurance book or certification of social insurance agency of compulsory social insurance and unemployment insurance. In case there is no social insurance book, clearly state the reason in the application.
After having sufficient papers, the employee submits the dossier to the commune-level People’s Committee.
The commune-level People’s Committee will review and determine the income level, summarize the list submitted to the district-level People’s Committee.
The district People’s Committee will appraise and submit to the Chairman of the provincial People’s Committee in 02 working days.
In only 03 working days, the Chairman of the provincial People’s Committee approves the list of support and support funds for employees.
3. For business households
* Conditions of support:
– Turnover of under VND 100 million is determined as of January 15, 2020;
– Suspension of business from April 1, 2020 under the Decision of the President of the provincial People’s Committee to implement the Prime Minister’s Directive No. 15.
* Support level:
Receive monthly support with 01 million VND / month and no more than 03 months.
* Procedures for receiving support:
Business households send the Request for Support with a copy of the tax payment notice, made according to form No. 01 / TBT-CNKD issued together with Circular 92/2015 / TT-BTC to the commune-level People’s Committee.
Within 05 days, the commune-level People’s Committee shall certify the business household’s suspension of business, post it publicly, sum up and report it to the Sub-department of Taxation.
Within 02 working days, the District Tax Office shall coordinate with the relevant agencies to submit to the district People’s Committee for consolidation.
Within 03 days, the district People’s Committee reviews, summarizes and submits to the Chairman of the provincial People’s Committee to issue a decision approving the list and funding support.
4. For laborers without labor contracts, they lose their jobs
* Conditions of support:
– Losing their jobs and earning income lower than the near-poverty line during the period from April 1, 2020 to June 30, 2020;
– Legal residence in the locality;
– Being in the non-agricultural field, doing one of the jobs such as street vendors, small businesses without fixed locations; collecting rubbish and scrap; loading and unloading, transporting goods; motorbike taxi, passenger cyclo; mobile lottery retail; self-employed or working in business households in the fields of eating, accommodation, tourism and health care.
* Support level:
Receive monthly support with 01 million VND / person / month and no more than 03 months.
* Procedures for receiving support:
If the conditions are met, the employee only needs to send the Request for Support to the Commune People’s Committee after the 15th of every month.
Within 05 working days, the communal People’s Committee will organize a review and make a list of employees eligible for support with the participation of supervisors of representatives of socio-political organizations and listing. publicize the list of employees requesting support in 02 working days and summarize the list of qualified employees to send to the district People’s Committee.
Within 02 working days, the district People’s Committee evaluates and submits to the Chairman of the provincial People’s Committee.
Finally, within 03 working days, the Chairman of the provincial People’s Committee will approve the list of support and support funds for employees.
5. For enterprises borrowing capital to pay workers’ discontinued wages
* Conditions of support:
– 20% or 30 employees or more participating in social insurance are required to stop working for 01 month or more; paid at least 50% of the termination salary for the employee in the period from April 1, 2020 to June 30, 2020;
– Being facing financial difficulties, failing to balance sufficient sources to pay job stoppage wages, having used up the wage reserve fund to pay workers to stop working;
– No bad debt at credit institutions, foreign bank branches as of December 31, 2019.
* Support level:
– Loans without collaterals up to 50% of the regional minimum salary for each employee according to actual pay period but not more than 3 months with 0% interest
– Maximum 12 months loan term at Vietnam Bank for Social Policies to pay the remaining salary and direct disbursement monthly to the unemployed.
* Procedures for receiving support:
If meeting these conditions, the enterprise will prepare 01 set of documents, including:
– An application for certification of the beneficiary of a loan policy to pay the job-stopping salary and enclose:
– Copy of one of the following documents: Enterprise Registration Certificate / Cooperative / Business Registration Certificate; Establishment decisions of competent State agencies; Business license / Operating license / Practicing certificate; Investment license / Investment certificate;
– List of employees who must stop working;
– A copy of the financial statements of 2019, Quarter I / 2020 (for enterprises and organizations).
At the latest on the 5th of every month, the enterprise needs to send the request to the People’s Committee of the district where the head office or branch, representative office, business location or residence is located (for business households). business, individual).
Within 3 working days after receiving a complete dossier, the district-level People’s Committee shall evaluate and synthesize the list and submit it to the provincial-level People’s Committee president.
Within 2 working days after receiving a complete dossier from the district-level People’s Committee, the president of the provincial-level People’s Committee shall decide to approve the list to send to the Social Policy Bank branch.
Within 03 working days from the date of receiving a complete loan application, VBSP will approve the loan.
The disbursement is made until the end of 7/31/2020.
6. For people with meritorious services to the revolution, social protection beneficiaries and people of poor and near-poor households
* Conditions of support:
– People with meritorious services to the revolution are those who are receiving monthly preferential benefits (including relatives of people with meritorious services who are receiving monthly preferential benefits, war invalids who are receiving monthly labor incapacity regime) in the list of April 2020 benefits book.
– Social protection beneficiaries are those who are receiving the monthly social allowance, in the list of social welfare in April 2020.
– People from poor and near poor households are on the List of poor and near-poor households in the locality as of December 31, 2019.
* Support level:
– People with meritorious services and social protection beneficiaries receive VND 500,000 / person / month for 03 months.
– People in poor and near poor households are supported VND 250,000 / person / month for 03 months.
* Procedures for receiving support:
For these subjects, the Chairman of the provincial People’s Committee will direct the review, review and approval of the list and funding support.
